Nebraska Grain Regulators Deny Motion Of Gettysburg Grain Dealer To Reconsider $290,000 Fine

LINCOLN, NE — A Nebraska grain regulatory agency has denied a South Dakota grain marketer’s request for reconsideration of a nearly 300-thousand dollar fine for operating in Nebraska as a grain dealer without a state license. Banghart Properties and a number of aliases under the Fearless Grain moniker, made the motion for reconsideration after the Nebraska Public Service Commission issued a 290-thousand dollar civil penalty against Banghart at a March 15 hearing in Lincoln. Nebraska regulators recommended an 870-thousand dollar penalty citing Banghart’s flagrant violation of Nebraska law and unwillingness to comply. Banghart Properties, of Gettysburg, filed the reconsideration motion March 25th. The P-S-C heard oral arguments in the appeal May 2nd. Banghart has 30 days to appeal the P-S-C’s denial of the motion to reconsider.
