Prison Time Restored For Man Who Violated Diversion Program

FORT PIERRE — Prison time has been reinstated for a man given a chance to avoid jail time for driving drunk in Stanley County. Stanley County States Attorney Thomas P. Maher says 30 year-old Kyle Leui had been given two years of prison with credit for time served on a third offense D-U-I. Leui wanted to complete participation in the Sixth Judicial Circuit’s Problem Solving Court and was sentenced to probation and the felony drug court program in June of last year. During the program, Leui committed several violations and recorded new drug offenses which caused termination of participation in drug court. Judge Margo Northup Tuesday revoked Leui’s probation and imposed the looming two-year prison term. Following sentencing, Leui was taken to the South Dakota State Penitentiary in Sioux Falls by the Stanley County Sheriff’s Office.
