PIERRE, (KCCR) — A Hughes County grand jury has indicted an Indianola, Iowa man on eight charges connected to a fatal U-T-V crash near Spring Creek on the Fourth of July. The Indictment was handed down Wednesday. Among the charges facing 38 year-old Zachary Berger are Vehicular Homicide and Second Degree Manslaughter. Berger was indicted Wednesday on one county Vehicular Homicide; one count of Second Degree Manslaughter; two counts of Abuse or Cruelty to a Minor; two alternate counts of Driving Under the Influence; Two Counts of Failure to Assure a Minor Passenger Wears a Seatbelt and one county of Failure to Wear a Seatbelt. A habitual offender information has been filed by the South Dakota Attorney General’s Office, which if proven, could enhance any sentencing if Berger is found guilty. Berger was driving a Polaris Ranger on Spring Creek Drive when the U-T-V crashed, killing a nine-year-old Waterloo, Iowa girl and injuring a 16 year-old male with minor injuries. Berger is being held at the Hughes County Jail on a 50-thousand dollar cash bond and is due in Court in Hughes County Jul 28th.
