PIERRE, (KCCR) — A series of motions were ruled on Tuesday during a motions hearing in the sexual assault case of 33 year-old Jarrett High Bear of Pierre. Most of the nearly 20 motions found no objection from High Bear attorney David Siebrasse or Hughes County States Attorney Casey Diebert. The case is being co-prosecuted with the South Dakota Attorney Generals Office. One motion objected to dealt with the possible admittance of notes taken by investigating police offices as evidence. Sixth Circuit Judge Christina Klinger ruled based on a lack of case law that those note can’t be included as evidence. Klinger also approved a defense motion for a private investigator for; what Siebrasse calls; a complex case. Klinger set a non-evidentiary hearing for August and a tentative three-day trial date in mid to late October. High Bear was indicted in May on 11 charges including rape and sexual contact. Court documents indicate the alleged crimes happened from January of 2018 to March of this year. High Bear remains in the Hughes County Jail on a 25-thousand dollar cash bond.
