PIERRE, (KCCR) — There will be no change in bond for an Iowa man charged in a fatal U-T-V crash on Independence Day near Spring Creek in northwest Hughes County. A bond modification motion was one of a dozen or so motions considered Tuesday in the case against 38 year-old Zachary Berger. Berger’s attorney Justin Bell asked Sixth Circuit Judge Christina Klinger to keep Berger’s bond at 50-thousand dollars cash, but make it a cash or surety bond saying if released, Berger would live with family in Hughes County and find work. Assistant Attorney General Jessica LeMie told Klinger Berger is a significant flight risk, reading from communications between Berger and a friend that if he was released he wouldn’t stay in Pierre. Klinger told both attorneys the cash or surety was not this concern for the Court, but insisted that electronic monitoring be a requirement of release and Hughes County doesn’t offer it. A trial date was not set, but the sides figured they would need a five-day jury trial. Berger is facing a count of vehicular homicide and second-degree manslaughter among other charges.
